Terms of Service

These Terms of Service (“Terms”) govern use of https://answerforge.xyz and related services operated by Jimmy Humania / answerFORGE™ (“we”, “us”). By using the site or purchasing a paid product, you agree to these Terms.

1. Parties & acceptance

• You must be 18+ (or have legal capacity to contract).
• Using the free audit or paying for unlocks/PDF constitutes acceptance.

2. The service

• Free AI Visibility Audit (€0) — automated AEO/GEO score and grade for a URL you submit.
• Diagnostic breakdown (€50, one-time) — digital unlock of full category notes on-page.
• Detailed AI Visibility Report (€100, one-time) — digital PDF emailed after Stripe payment (includes diagnostic unlock).
• Retainer / consultant work — sold separately via discovery call / invoice; not automated Stripe Checkout unless stated.

answerFORGE is informational / diagnostic tooling. We do not guarantee rankings, AI citations, traffic, or business results. Scores are automated estimates and can change with crawl time, page changes, and third-party AI systems.

3. What we are not

• Not a crypto exchange, wallet, custody service, gambling, adult marketplace, or payment facilitator.
• We do not implement changes on your website unless separately agreed (e.g. retainer).

4. Access & your responsibilities

• No mandatory account today — access via submitted URL, optional contact, and Stripe Checkout for paid tiers.
• You must have the right to submit the URL for auditing.
• Provide a valid email at Checkout for PDF / receipt delivery.
• We may refuse or rate-limit abuse (bots, empty UA, mega-site blocks, spam) without notice.

5. Billing

• Paid SKUs are priced in EUR, one-time (not a subscription).
• Payment is processed by Stripe; Stripe’s terms apply to the payment step.
• Delivery is digital only (on-page unlock and/or email PDF).
• Prices shown are as listed on the site; taxes may apply depending on your location.

6. Refunds

Digital goods; see the Refund Policy. No refunds for disagreement with scores or recommendations. Goodwill refunds only for non-delivery, duplicate charge, or proven technical failure.

7. Acceptable use

• No scraping or abusing the free audit API beyond fair use.
• No using the service to violate law or harm others.
• No bypassing paywalls or reverse-engineering to steal output.
• No reselling our PDF/report as your own product without permission.

8. Intellectual property & public scores

• answerFORGE brand, site, audit engine, and report templates are our IP.
• You keep rights to your site; you get a license to use the report for your own business.
• We may use aggregated / anonymized stats for product and marketing.
• Successful free audits may create a public score page at /scores/<slug> and appear in the Recent audits feed (URL/host, score, grade). Do not submit URLs you need kept private.

9. Communications

• Transactional email (receipts, PDF) is required for paid orders.
• Marketing / Telegram follow-up only when you opt in.
• See the Privacy Policy.

10. Third parties

We rely on providers including Stripe, Resend, Vercel, Upstash/Redis, Google PageSpeed Insights, and optionally X/Telegram for ops or auto-posts. Availability depends on those services.

11. Disclaimers

Service is provided “as is” and “as available.” No warranty of uninterrupted service, accuracy, or results. AI citation outcomes depend on third-party engines outside our control.

12. Liability

• To the extent allowed by law, our total liability is capped at fees you paid us in the prior 12 months (or €100 if you only used the free audit).
• We exclude indirect or consequential damages where permitted.
• Mandatory consumer rights are not excluded where forbidden.

13. Indemnity

You indemnify us for claims arising from URLs you submit or misuse of the service.

14. Suspension

We may suspend access for abuse, fraud, or Terms / Stripe violations. IP, liability, and already-processed refund clauses survive.

15. Governing law

These Terms are governed by the laws of Germany, without regard to conflict-of-law rules, unless mandatory consumer law in your country requires otherwise. Courts of competent jurisdiction in Germany apply, subject to mandatory consumer venue rights.

16. Changes

We may update these Terms. Material changes are posted on this page with an updated date. Continued use after posting means acceptance.
